Marshall Begins A Tower Moratorium

The February meeting of the Board of the Town of Marshall opened with approval of the minutes of the January meeting.


Following that was the Public Hearing for a six-month moratorium regarding the establishment of communication towers. Supervisor Colleen Baldwin read the resolution aloud to the public.


That included antennas and any related telecommunications facilities and construction within the Town of Marshall, and any negative environmental impacts this may have. The Board voted to adopt the resolution.


With the resignation of Town Justice Justin Nackley, Dorothy Spina has been appointed Town Justice.


The Planning Board met to discuss Dan Williams’ request for a zoning change on his properties on Brothertown Road and Van Hyning Road. He requested the change from agriculture to business.


The Planning Board recommended against the zone change, Planning Board Chairman Dante Ruia reported.


He said so did the Oneida County Planning Board, citing the fact that changing zones might result in undesirable development.


All these matters were presented to Williams and his attorney. Town Attorney Bill Schmitt suggested the matter be turned over to the Zoning Board of Appeals for a Special Use Permit or a Use Variance which, he said, is difficult to obtain.


A resolution was made by the Town Board to refer the matter to the ZBA. The ZBA will discuss that matter at their next meeting.


Schmitt suggested the Town Board adopt a local law authorizing them to appoint alternate members to the ZBA or the Planning Board, as needed.
